Purpose, Scope, and Acknowledgment
This Privacy Policy explains how Bright Companion Care LLC ("Bright Companion Care," the "Company," "we," "us," or "our") collects, uses, maintains, protects, retains, and discloses information in connection with our website, inquiries, intake and onboarding, Client Service Agreement, nonmedical and nonclinical services, communications, payment processes, and related business operations.
This Privacy Policy applies to Clients, prospective clients, Authorized Representatives, Financially Responsible Parties, family members and other authorized information recipients, website visitors, and other individuals who provide information to Bright Companion Care.
When this Privacy Policy is made available as part of an intake, payment, agreement, or other authorized Company process, an individual may be asked to acknowledge that the Privacy Policy has been provided or made available. Acknowledgment does not constitute consent to practices for which separate consent is required by applicable law. Acknowledgment of this Privacy Policy does not create legal authority for one person to act for another and does not expand the scope of Services.
Information We May Collect
Bright Companion Care may collect information reasonably necessary to evaluate, arrange, provide, document, coordinate, and bill for Services and to operate the business. Depending on the relationship and Services requested, this may include:
- Identity and contact information, including name, mailing or service address, telephone number, email address, and communication preferences.
- Client and household information, including emergency contacts, household access information, routines, preferences, pets, and relevant environmental or safety information.
- Information relevant to nonmedical Services and safety, including mobility, transfer ability, personal-care needs, communication needs, supervision concerns, equipment, dietary preferences or restrictions, allergy information relevant to nonclinical safety or support, and other information voluntarily provided for coordination or safety.
- Information concerning an Authorized Representative, Financially Responsible Party, emergency contact, payer, or other authorized person, including documentation of legal authority when applicable.
- Scheduling, service, communication, complaint, incident, authorization, and business records.
- Billing and transaction information. Payment-card and bank-account credentials should be entered directly into the Company's designated payment processor rather than provided to Bright Companion Care through ordinary email or text message. Bright Companion Care may receive limited transaction information from its payment processors, such as payment status, amount, date, payer information, or transaction reference information.
- Website and device information that may be collected automatically by the website or its service providers, such as IP address, browser or device information, pages visited, referral information, timestamps, and cookies or similar technologies.
Sensitive and Client-Specific Information
Because Bright Companion Care provides companionship, personal care, lifestyle support, and administrative family care coordination, individuals may provide information concerning health conditions, medications, appointments, mobility, daily routines, safety concerns, family circumstances, or other sensitive matters.
Bright Companion Care collects, uses, and maintains such information only to the extent reasonably necessary or relevant to providing requested nonmedical and nonclinical Services, promoting safety, coordinating permitted services, fulfilling legal obligations, or conducting legitimate business operations.
Ezinne Akalonu's Registered Nurse credential identifies her professional background. Information provided to Bright Companion Care does not by itself convert the Company's Services or records into nursing, medical, home health, or clinical care.
How We Collect Information
Information may be collected directly from the Client; from an Authorized Representative or another person permitted or authorized to provide information to Bright Companion Care; through the Company website, inquiry or intake forms, telephone calls, text messages, email, meetings, service visits, contracts, payment processes, and other communications; and from third parties involved in coordination when requested or authorized by the Client or Authorized Representative, or when collection is otherwise permitted or required by law.
How We Use Information
Bright Companion Care may use information as reasonably necessary to:
- Respond to inquiries and determine whether requested Services are within the Company's nonmedical scope and one-provider capacity.
- Conduct intake, prepare proposals and agreements, schedule and provide Services, and communicate with authorized persons.
- Coordinate appointments, vendors, transportation providers, community resources, or other third parties when included in the selected package.
- Process payments, maintain billing and accounting records, and address payment questions or failed payments.
- Maintain service, safety, complaint, incident, authorization, and business records.
- Support safety; respond to emergencies; and protect the rights, property, or legitimate interests of the Client, Provider, Company, or others, including addressing suspected fraud, misuse, or unlawful activity.
- Comply with legal, regulatory, insurance, accounting, tax, recordkeeping, and other legitimate business obligations.
- Establish, exercise, or defend legal rights and enforce agreements.
- Maintain, secure, troubleshoot, support, and improve the Company's website, communications, and business systems.
When Information May Be Shared
Bright Companion Care does not sell or rent personal information.
The Company may disclose information only as reasonably necessary for the purposes described in this Privacy Policy, including to:
- The Client and persons the Client or a legally authorized representative has authorized to receive information.
- Service providers that support website hosting, communications, document management, payment processing, accounting, scheduling, security, technology, or other business operations, subject to appropriate contractual or security arrangements when required.
- Healthcare offices, pharmacies, transportation providers, community programs, vendors, or other third parties when coordination is requested or authorized and falls within the selected package.
- Emergency responders or other appropriate persons when reasonably necessary to address an emergency or immediate safety concern.
- Government agencies, regulators, courts, law enforcement, insurers, attorneys, accountants, or other appropriate parties when disclosure is required or permitted by applicable law, necessary to comply with a legal obligation, or reasonably necessary to establish, exercise, or defend legal rights.
A family relationship, emergency-contact designation, payment responsibility, or status as an information recipient does not by itself authorize a person to direct Services, sign for the Client, or receive information beyond the authority or permission actually granted.
Payment Information and Payment Processors
Bright Companion Care uses third-party payment processors, currently including Stripe for intake payments and GoCardless for recurring ACH payments, or other designated payment processors as applicable. Clients should enter payment-card or bank-account information directly into the designated processor's secure system when available. Bright Companion Care does not request that Clients send complete bank-account numbers, routing numbers, payment-card numbers, passwords, PINs, or security codes through ordinary email or text message.
Payment processors and financial institutions collect and process information under their own privacy notices, terms, security practices, and legal obligations. Bright Companion Care may receive transaction information such as payer name, contact information, payment amount, payment status, transaction identifiers, and limited payment or account information made available by the processor for reconciliation, support, or recordkeeping.
Website, Cookies, Analytics, and Online Forms
The Company website and its hosting, security, analytics, form, or other technology providers may use cookies, logs, pixels, or similar technologies to operate the website, remember preferences, understand website usage, maintain security, and improve website functionality and performance. The specific technologies used may change as the website is developed or updated.
Where applicable law requires notice, consent, or choice regarding cookies or other tracking technologies, Bright Companion Care will provide the required notice or mechanism. Users may also be able to limit or block certain cookies through their browser or device settings, although doing so may affect website functionality.
Sensitive payment-card or bank-account credentials should be submitted only through the Company's designated secure payment process and not through general website inquiry forms, ordinary email, or text message.
Email, Text Messages, and Electronic Communications
Bright Companion Care may communicate by telephone, text message, email, website forms, or another agreed method. Ordinary email and text messaging may involve privacy or security risks outside the Company's control. Clients should avoid sending highly sensitive financial credentials or other sensitive personal information through ordinary email or text when a more secure method is available.
Communications may be retained when reasonably necessary for scheduling, service coordination, billing, safety, documentation, legal compliance, dispute resolution, or other legitimate business purposes.
Marketing and Promotional Communications
Bright Companion Care may use contact information to respond to an inquiry, follow up about requested Services, or communicate about an existing relationship. Promotional email or text communications, if used, will be sent in accordance with applicable law and any required consent or opt-out requirements. A person may ask Bright Companion Care to stop nonessential promotional communications without affecting necessary service, safety, billing, or legal communications.
Client names, photographs, testimonials, recordings, or other identifiable Client content will not be used for Company advertising or promotional purposes without separate permission or consent, as required by applicable law.
Cameras, Audio Recording, Photographs, and Media
The Client or household must disclose cameras or other recording devices in service areas as required by Company policy and applicable law. Bright Companion Care does not authorize secret audio recording of the Provider.
Massachusetts law restricts the secret interception or recording of wire or oral communications, including certain recordings made without the prior authority of all parties, subject to applicable statutory exceptions.
Any separate use of a Client's photograph, video, testimonial, voice, or other identifiable content for advertising, social media, or promotional purposes requires appropriate consent and is not authorized merely by accepting this Privacy Policy or the Client Service Agreement.
Information Security and Massachusetts Personal Information
Bright Companion Care maintains and will maintain reasonable administrative, technical, and physical safeguards designed to protect information against unauthorized access, use, alteration, disclosure, loss, or destruction, taking into account the nature of the information and the size, scope, resources, and operations of the Company.
To the extent Bright Companion Care owns or licenses "personal information" concerning Massachusetts residents as defined by Massachusetts law, the Company will maintain a written information security program ("WISP") and safeguards required by applicable Massachusetts law, including M.G.L. c. 93H and 201 CMR 17.00. Those safeguards may include access controls, secure authentication, appropriate storage and transmission practices, service-provider oversight, risk assessment, and procedures for responding to security incidents, as applicable to the Company.
No method of storage, transmission, or security can be guaranteed to be completely secure. Bright Companion Care therefore uses safeguards designed to reduce risk rather than promising absolute security.
Security Incidents and Breach Notification
If Bright Companion Care becomes aware of a security incident involving information, the Company will investigate, document, and respond as appropriate to the circumstances. When Massachusetts or other applicable law requires notification concerning a breach of security, unauthorized acquisition, or unauthorized use of covered personal information, Bright Companion Care will provide required notices to affected individuals, governmental authorities, or other required parties as soon as practicable and without unreasonable delay, subject to applicable law and any legally authorized delay.
Records, Retention, and Secure Disposal
Bright Companion Care may retain information for as long as reasonably necessary for the purposes for which it was collected; to provide and document Services; maintain business, insurance, accounting, and financial records; comply with legal or regulatory requirements; resolve disputes; enforce agreements; address safety matters; and establish or defend legal rights.
When records containing covered Massachusetts personal information are no longer reasonably necessary to be retained, Bright Companion Care will dispose of them using methods designed so that the personal information cannot practicably be read or reconstructed, consistent with applicable law, including M.G.L. c. 93I where applicable, and the Company's record-retention and information-security practices.
Access, Corrections, and Communication Preferences
Individuals may contact Bright Companion Care to request correction of inaccurate contact or operational information, update communication preferences, or request a summary of contact and scheduling information maintained by the Company. Bright Companion Care may need to verify identity or legal authority before providing, changing, or discussing information.
A request to delete, restrict, or provide information may be limited when retention, use, or nondisclosure is reasonably necessary to provide Services, maintain required records, complete transactions, protect safety, comply with law, preserve another person's privacy, resolve disputes, or establish or defend legal rights. Bright Companion Care will honor privacy rights that are legally applicable to the Company.
Third-Party Websites and Services
The Company website or communications may contain links to or interact with third-party websites, payment processors, scheduling systems, transportation providers, or other services. Bright Companion Care does not control the privacy, security, or data practices of independent third parties. Individuals should review the privacy notices of those services when appropriate.
Children's Privacy
The Bright Companion Care website is not directed to children under 13, and the Company does not knowingly use the website to solicit personal information directly from children under 13. This section applies to the website only. It does not restrict Bright Companion Care from handling information about household members who may be present during service visits, which is managed through the appropriate parent, guardian, or legally authorized person as applicable and in accordance with applicable law.
Massachusetts Home-Care Regulatory Requirements
Massachusetts enacted Chapter 180 of the Acts of 2026, establishing a home-care agency licensing and oversight framework. Bright Companion Care will comply with licensing, privacy, confidentiality, recordkeeping, consumer-protection, complaint, safety, training, and other requirements applicable to the Company under Chapter 180 and its implementing regulations as those requirements become legally applicable. Nothing in this Privacy Policy expands or changes the Company's nonmedical and nonclinical scope of Services.
Changes to This Privacy Policy
Bright Companion Care may update this Privacy Policy prospectively to reflect changes in law, regulation, technology, website practices, payment processes, service providers, or business operations. The current version will be identified by an effective date or version number.
Material changes will be communicated, posted, or presented for acknowledgment when required by applicable law or reasonably appropriate to the circumstances. Any additional consent required by applicable law for a particular change or information practice will be obtained when required.
